Terms of Service

1. Who these terms are with
Kaptly is operated by an individual sole proprietor based in Serbia. [CONFIRM: registered business name/entity type under Serbian law — including whether accepting payments requires registered "preduzetnik" status — and the registered address. This is a local lawyer/accountant question, not something this document guesses at.]
2. Public beta status
Kaptly is provided as a public beta. See the Public Beta and Product Disclaimer for what that means. By using Kaptly you accept the risks described there, including possible bugs, interruptions, and incorrect states.
3. Your account
You must be at least 18 years old to create a Kaptly account. You're responsible for the accuracy of the information in your account and for keeping your password confidential. Notify us if you believe your account has been compromised.
4. Your content
You retain ownership of the forms you build and the responses you collect. You're responsible for having the right to collect any data you request from respondents, and for complying with the Acceptable Use Policy and applicable law in what you ask for and how you use it.
If workspace collaboration is available to you, every current teammate has full access to the workspace's forms, responses, exports, brands, folders, fonts, uploads, and enabled integrations; this is not view-only access. The workspace owner is responsible for inviting only trusted people and for their use of workspace data. Removing a teammate stops future Kaptly access immediately, but cannot recall data they already downloaded, copied, or sent through an integration.
5. Fees
Kaptly is currently free to use. Support contributions (Ko-fi) are voluntary and are not a paid subscription plan; they do not currently unlock any feature that isn't otherwise available. [CONFIRM: state clearly if/when a paid plan is introduced, and update this section before launching one.]
6. Acceptable use
You agree to the Acceptable Use Policy, including its rules on the type of data you may collect through a published form.
7. Disclaimer of warranties
Kaptly is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Kaptly is not represented as fully secure, GDPR compliant, production-grade, enterprise-ready, or audited unless a specific claim on this page states otherwise with supporting evidence.
8. Limitation of liability

9. Termination
You may stop using Kaptly at any time and permanently delete your own account, with everything it contains, from Settings → Danger zone — this takes effect immediately, with no grace period. See the Privacy Policy's data retention section for exactly what's deleted and the narrow set of things Kaptly may still retain afterward. [CONFIRM: process and notice, if any, for Kaptly itself suspending or terminating an account for an Acceptable Use Policy violation.]
If other people are members of the workspace you own, account deletion also permanently deletes that workspace and all of its forms, responses, brands, fonts, and uploads, and immediately removes their access. Workspaces owned by other people remain, while your memberships in them are removed. Kaptly shows this stronger consequence before deletion.
10. Governing law
These terms are governed by the law of Serbia, and disputes arising from them are subject to the jurisdiction of Serbian courts. [CONFIRM: specific court/venue, any consumer-protection carve-outs required under Serbian law, and whether an alternative dispute resolution mechanism should be offered — a local lawyer needs to confirm the precise wording.]
11. Changes to these terms
